By accessing or using ProveForecast ("the Service"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service. These terms apply to all users, including trial and paid subscribers.
ProveForecast provides acoustic screening estimates for offshore surveys based on historical Environmental Plan data sourced from the NOPSEMA Environmental Register. Results are indicative only and are intended to support early-stage environmental impact assessment preparation. The Service does not constitute formal acoustic modelling, site-specific prediction, or regulatory advice.
You may use the Service for lawful professional purposes only. You must not: (a) attempt to reverse-engineer, scrape, or extract the underlying database; (b) share your account credentials; (c) use the Service to produce outputs that misrepresent their indicative nature; or (d) use automated means to access the Service without prior written consent.
Trial accounts include 5 screenings at no cost. Paid subscriptions are billed monthly via Stripe. You may cancel at any time; access continues until the end of the billing period. Refunds are not provided for partial billing periods. Prices are in Australian dollars and exclude GST unless stated otherwise.
All content, software, and data in the Service are owned by or licensed to Klarite Pty Ltd. Source data is derived from publicly available NOPSEMA Environmental Plans. You retain ownership of any inputs you submit. You grant Klarite a limited licence to process your inputs to provide the Service.
The Service is provided "as is". Klarite Pty Ltd makes no warranty that results are complete, accurate, or suitable for any particular purpose. To the maximum extent permitted by Australian law, Klarite's liability is limited to the fees paid by you in the three months preceding the claim. Klarite is not liable for loss of data, indirect, incidental, or consequential damages.
ProveForecast results are screening-level estimates derived from historical analogues. They do not replace formal acoustic modelling by a qualified specialist. Users are responsible for determining whether formal modelling is required for their specific survey and regulatory context. Klarite accepts no responsibility for decisions made on the basis of Service outputs.
These Terms are governed by the laws of Western Australia, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Western Australia.
Klarite may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. Material changes will be notified by email to registered users.
